These terms govern your use of this website, operated by White Pines. By using the site, you agree to them. If you don't agree, please don't use the site.

Use of the site

You may use this site to learn about our services and to request a quote. You agree not to misuse the site — for example, by submitting false or fraudulent information, attempting to overload or disrupt it, sending spam through the contact form, or trying to access data you aren't entitled to. The contact form is protected against automated abuse; attempting to bypass those protections is prohibited.

Estimates and pricing

Any estimate provided before an in-person assessment is approximate and based on the information you give us. We make no warranty as to the accuracy of an estimate made without seeing the property. A final, written price is provided after we assess the job in person, and no work begins without your approval of that price.

Scheduling and weather

Scheduling is subject to availability. Exterior work depends on conditions. We will not pressure wash in heavy rain, high wind, or freezing temperatures that would make the work unsafe or ineffective. If weather forces a reschedule, we will contact you to set a new date as soon as possible.

Your property

You agree to make the work area reasonably accessible and to let us know in advance about any fragile surfaces, pets, or conditions we should be aware of. We are not responsible for pre-existing damage, defects, or conditions that become apparent only during cleaning.

Limitation of liability

To the fullest extent permitted by law, White Pines is not liable for indirect, incidental, special, or consequential damages arising from your use of the site or our services. Our total liability for any claim arising out of or relating to our services is limited to the amount you paid us for the specific work that gave rise to the claim.

No warranty beyond cleaning

We stand behind our cleaning work and will return to address any area you're not satisfied with. We do not warrant against the reappearance of mildew, algae, or stains, which are caused by environmental conditions outside our control.

Assumption of risk and pre-existing conditions

Pressure washing and soft washing use water, pressure, and cleaning solutions on exterior surfaces. Older, weathered, or previously damaged surfaces can fail under cleaning that sound surfaces tolerate. You represent that you have disclosed any fragile, cracked, loose, or previously repaired surfaces, and that the property is in suitable condition for the services requested. We are not responsible for damage to surfaces that were already compromised, for pre-existing defects that become visible only after cleaning, or for items left in or near the work area.

This website is provided "as is" and "as available." We make no representations or warranties of any kind, express or implied, about its operation or the information on it. To the fullest extent permitted by law, we disclaim all warranties, including merchantability and fitness for a particular purpose. We do not warrant that the site will be uninterrupted or error-free.

User-submitted content

Reviews and other content submitted through this site reflect the personal opinions of the individuals who wrote them, not White Pines. We do not endorse, verify, or adopt as our own any user-submitted content. To the fullest extent permitted by law, White Pinesis not liable for the content of user reviews. You are responsible for the accuracy and lawfulness of what you submit and agree not to post defamatory, false, or infringing content. We may remove any submission at any time and for any reason, without notice.

Indemnification

You agree to indemnify and hold harmless White Pines and its owners from any claim, damage, loss, or expense (including reasonable attorneys' fees) arising out of your use of the site, your submissions to it, or your breach of these terms, except to the extent caused by our gross negligence or willful misconduct.

Force majeure

We are not liable for any delay or failure to perform when caused by conditions outside our reasonable control, including weather, acts of God, utility outages, or government orders. We will reschedule affected work as soon as practicable.

Dispute resolution and arbitration

Except for claims that may be brought in small-claims court, any dispute or claim arising out of or relating to these terms or our services shall be resolved by binding arbitration administered in the Commonwealth of Massachusetts under its then-current consumer arbitration rules, and judgment on the award may be entered in any court of competent jurisdiction. You and White Pines agree that each may bring claims only in an individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. This section does not prevent either party from seeking injunctive relief in a court of competent jurisdiction to protect intellectual property.

Limitation period

You agree that any claim or cause of action arising out of or related to the site or our services must be filed within one (1) year after such claim or cause of action arose, or it is permanently barred.

Governing law

These terms and any dispute arising from them or from our services are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws principles. Any legal action shall be brought in the courts located in Middlesex County, Massachusetts.

Changes to these terms

We may update these terms from time to time. When we do, we'll change the effective date at the top of this page. Your continued use of the site after a change means you accept the updated terms.
